1. Acceptance of Terms

By downloading, accessing, or using TRAK (“the App”), operated by Kiwi Labs LLC (“we,” “us,” “our”), you agree to these Terms of Use. If you do not agree, do not use the App.

2. The Service

TRAK is a fitness tracking application that lets you log lifting, running, nutrition, and recovery data and provides AI-generated coaching, insights, and analysis based on the data you provide.

3. AI-Generated Content — Not Medical Advice

TRAK includes AI-powered features (“Ask TRAK,” “TRAKY,” insights, and coaching). All AI-generated content is for informational and general fitness purposes only. It is NOT medical, health, nutritional, or professional advice, and must not be relied upon as a substitute for consultation with a qualified physician, dietitian, or other licensed professional. AI output may be inaccurate or incomplete. Always consult a qualified professional before beginning any exercise program, changing your diet, or making decisions about your health. You use AI-generated content at your own risk. Do not use the App for emergencies.

4. Health and Fitness Disclaimer

Physical exercise carries inherent risks. You are solely responsible for exercising safely and within your ability. Consult a physician before starting any fitness or nutrition program. By using the App you acknowledge these risks and agree that Kiwi Labs LLC is not liable for any injury, health condition, or loss resulting from your use of the App or reliance on its content.

5. Subscriptions, Billing, and Cancellation

TRAK offers auto-renewable subscriptions (“TRAK Pro”) at $14.99/month or $64.99/year, with a 14-day free trial for new subscribers. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings after purchase. Any unused portion of a free trial is forfeited when you purchase a subscription. All purchases are processed by Apple and subject to Apple’s terms; refunds are handled by Apple according to their policies.

6. User Content and Data

You retain ownership of the training data you enter. You grant us a limited license to process that data to provide the App’s features, including generating AI insights. Our handling of your data, including health data, is described in our Privacy Policy at trakfit.app/privacy.

7. Acceptable Use

You agree not to misuse the App, including: attempting to access it through unauthorized means; reverse-engineering or circumventing the App’s paywall, entitlement, or security systems; using automated systems to extract AI-generated content; or using the App for any unlawful purpose.

8. Intellectual Property

The App, its content, branding, and software are owned by Kiwi Labs LLC and protected by applicable laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI output will be accurate.

10. Limitation of Liability

To the fullest extent permitted by law, Kiwi Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the App or reliance on its content. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.
